State regulators move to order Charter out of NY

They ordered Charter, doing business as Spectrum, to file a plan within 60 days to ensure an "orderly transition to a successor" provider or providers.

"Charter continues to show an inability or a total unwillingness to extend its network in the manner intended by the Commission to pass the requisite number of unserved or underserved homes and/or businesses", John B. Rhodes, chair of the commission, said in a 28-page decision.

The Public Service Commission had previously fined Charter $2 million for failing to meet the broadband deadlines and voted Friday to force the company to forfeit $1 million in credit that was approved as part of the merger.

Governor Andrew Cuomo's administration has argued Charter has misled customers by suggesting it has exceeded its benchmarks in rolling out broadband service to rural areas via its Spectrum cable products.

"We need to seek a different provider", he said.

In a meeting on Friday, the New York State Public Service Commission voted unanimously to revoke its approval of the 2016 merger agreement between Charter and Time Warner Cable because, since the merger, the company has apparently made it clear that it has no intention of following through with its side of the bargain.

Charter, which does business as Spectrum cable in NY, has been locked in a battle with Gov. Andrew Cuomo's administration over the rollout of high-speed internet access in rural areas of the state.

The company is the major cable, Internet and phone service provider for two million subscribers in Rochester, Buffalo, Syracuse, Albany, Manhattan, Staten Island, Queens, and parts of Brooklyn. "After more than a year of administrative enforcement efforts to bring Charter into compliance with the Commission's merger order, the time has come for stronger actions to protect New Yorkers and the public interest".

But Charter has not lived up to that condition, and it also has listed addresses in its build-out reporting that it was instructed not to include, Sipos said.

"In the weeks leading up to an election, rhetoric often becomes politically charged", the company said in a statement.

Charter is also accused of "below standard installation and construction work" including, the commission claims, improperlyinstalling poles and leaving detached wires laying on the ground.

"The fact is that Spectrum has extended the reach of our advanced broadband network to more than 86,000 NY homes and businesses since our merger agreement with the PSC", the email from Charter stated.
