Governor asks for federal probe of detained pizza man

Villavicencio's wife, Sandra Chica, said he went to deliver pizza to Fort Hamilton last week and was asked for identification by the guard who received him. "This decision is also a reminder that the judiciary can still serve as a powerful check when other branches of government make hasty, cruel and reckless decisions".

Cuomo offered Villavicencio free legal representation and services through the Liberty Defence Project, a state-led project to assist immigrants. After Villavicencio couldn't produce a New York State Driver's License for identification, a guard at the Fort Hamilton in the Brooklyn borough of New York called Immigration and Customs Enforcement on him as he tried to deliver a pizza to the military base.

Pablo Villavicencio was taken into custody on June 1, 2018, at Fort Hamilton Army Base in Brooklyn and now faces deportation.

Villavicencio, who is married and has two daughters who are USA citizens, agreed in 2010 to voluntarily depart the country after an immigration judge ordered him to depart the U.S. He's trying to stay here in the legal way.

Officials said deliveryman Pablo Villavicencio was detained June 1 after a routine background check at the garrison's gate revealed there was a warrant for his arrest for immigration law violations.

He had been to the base several times before, presenting his NY city ID card that carries no mention of his immigration status.

An Army spokeswoman told The New York Times that if visitors don't have a military identification card, they have to get a pass that requires a background check.

He'd been there enough, Copeland said, that he was familiar with the facility's personnel. The soldier called the New York Police Department, which told him that Villavicencio did not have a criminal record.

New York Senator Chuck Schumer along with Governor Cuomo say they will fight to keep the young father from being sent back to Ecuador.

Democrat Andrew Cuomo requested the probe Friday in a letter to the Department of Homeland Security's inspector general.

"New York will not sit on the sidelines as our immigrant communities are threatened", Cuomo wrote.

Though he will remain in detention at the Hudson County Correctional Facility in Kearny, New Jersey - in the custody of ICE - the stay will allow Villavicencio to work on obtaining permanent US residency and hopefully be reunited with his family, legal aid said. "He should be immediately released from ICE custody and an investigation should be launched into the circumstances of his arrest".

Earlier this week, Villavicencio spoke to KTLA sister station WPIX in NY from an ICE detention center in New Jersey. "The Constitutional guarantee of due process affords him that basic right".
